Compensation for the damages at work in Japan

Question
I want to get information about a compensation claim. I has been in a terrible accident at work. I has been in hospital for one months. I would like to know if I am able to make a claim against my company.

Answer
I will explain on the assumption that you were injured in Japan.
I will explain separately as below.
If you are employed by company:
You are able to ask compensaton for expense of medical treatment, 60 percent of wage and aftereffect whether company was responsible for the accident or not. For that purpose almost all companies are insured.
You are able to ask all compensaton if the company was responsible for the accident.

If your conduct constituted gross negligence in the accident, you are not able to ask above compensation.

If you are not employed by company:
You are able to ask compensaton for expense of medical treatment, wage and aftereffect on the assumption that company was responsible for the accident.

Your rights are decided in Labor Standard Law, article 75 and Civil Law, article 709.
