/波崎事件、被告冨山常喜さん救援のお願い/

 1963年から32年間、無実を訴えている死刑囚冨山常喜(79才)さんを救出するため、支援をお願いしたく、この手紙を書いています。国際的な友情に感謝の念をこめ支援をお願いします。

波崎事件のあらまし

 茨城県の小さな町波崎町で1963年8月26日午前0時前後、冨山常喜宅から帰宅したI.Y.さん(当時35才)が急に苦しみだし、26日午前1時 30分死亡しました。警察の調べでは、死亡したI.Y.の胃の内容物からシアンが検出されたとして、11月9日冨山常喜さん(当時46才)が殺人容疑で逮捕されました。

 警察の捜査にも関わらず、冨山常喜さんの身辺からは、毒物のシアンも、毒物の入手経路も発見できず、物的証拠のないまま起訴されました。冨山常喜さんは逮捕されてから一貫して無実を主張しつづけました。

 自白もないまま、第一審では、物的証拠もなく、明確な殺人の動機もなく、状況証拠のみで有罪と断定され、1966年12月24日死刑を宣告されました。第二審東京高等裁判所も、1973年7月6日、第一審と同様の判決を宣告されました。1976年最高裁判所は上告を棄却し死刑が確定しました。

 冨山常喜さんの無実の訴えを知った人々は冨山常喜さんの救援会を組織し,10年にわたる裁判記録を調査研究した結果、冨山常喜さんの無実を確信したので、1980年4月9日に再審請求書を提出しましたが、1984年1月 25日却下されました。1987年11月4日第二次再審請求書を新しい弁護団と共に提出し、現在その補充書の準備中です。

 裁判所のこの事件に対する判断は前例のないものでした。物的証拠、本人の自白、明確な殺人の動機もないまま状況証拠のみで富山さんの死刑が確定されました。富山さんは現在東京拘置所から無実を訴えています。富山さんは32年間自由を奪われ、現在79才です。日本の法律では厳密には、再審請求の準備中であっても死刑が執行されることはありうることです。富山さんも例外ではありません。富山さんは危機的状態で何年もの時間を過ごしています。

 我々は冨山常喜さんに再審の道が開けるよう、世界中の人々に支援していただくことを要請するものです。波崎事件の冨山常喜さんに再審の道を開くよう日本の総理大臣と法務大臣に要請の手紙を出して下さい。皆さんの国際的支援と友情に感謝します。

/Request to rescue Mr. Tomiyama, imprisoned for the Hazaki incident under the sentence of death/

Dear Sir,

Since 1963, over the 32 years ago, Mr. Tomiyama has been insisting onhis innocence of the Hazaki incident. He is imprisoned under the sentenceof death in Tokyo detention center. We the members of groups which supportMr. Tomiyama would like to gratefully request the further support of ourfriends around the world to stop his execution and for opening his retrial.

Outline of the Hazaki Incident

On 26 August 1963 at or slightly after 0:00 a.m. Y. I. (age 35 at the time of the incident) was seized by pain several minutes after his return home from Tuneki Tomiyama's home in the small town of Hazaki in Ibaraki prefecture. Y. I. was carried to a nearby hospital, and died at 1:30 a.m.According to an autopsy, cyanide was detected in the contents of Y.I's stomach. Mr. Tomiyama was arrested on 11 November 1963 on suspicion of murder.

The police investigated the case on the assumption that the cyanide had been introduced in a capsule and that this capsule had been given to Y. I. by Tomiyama. However, they could not discover any materials evidence concerning the poisoning, the capsule or the means by which Tomiyama had supposedly obtained the cyanide. Throughout an extremely severe investigation, Tomiyama pleaded his innocence. In spite of this, as well as the absence of any material evidence, or any clear and reasonable motive for murder, Mito Regional Court Tsuchiura Branch sentenced Tomiyama to death on 24 December 1966 based entirely on circumstantial evidence. In the second trial, the Tokyo High Court reached a similar conclusion as that of the first trial, and sentenced Tomiyama to death on 6 July 1973. In 1976 the Supreme Court rejected an appeal by Tomiyama, and confirmed the death penalty.

However, after a detailed investigation of the trial records, a citizens' group and lawyer Hiroshi Shoji reached the conclusion that Mr. Tomiyama is innocent, and started to organize a group to support him. On 9 April 1980 they succeeded in filing an application for retrial, but this appeal was rejected on 25 January 1984. On 4 November 1987 a second appeal for retrial was submitted. With the legal help of new defense counsel, we are preparingthe supplement for this appeal.

The judgment of the courts in this case is unprecedented. Despite the lack of material evidence,absence of a confession by the accused, and without any reasonable motive for murder, Mr. Tomiyama was convicted and sentenced to death on the basis of purely circumstantial evidence. Mr. Tomiyama is now in the Tokyo Detention Center insisting on his innocence. He has been deprived of his freedom for 32 years, and he is now 79 years old. Strictly speaking even a prisoner who is preparing an appeal for retrial, can be executed according to Japanese law. Mr. Tomiyama is not an exception. He has been in peril for these many years.

We would like to request a support for Mr. Tomiyama from all our friends around the world. What we would like to propose is for you to write letters to the Prime Minister and the Minister of Justice to plead for a way to open his retrial. Thank you for your friendship!
